Use of PaxSoft Web Services constitutes acceptance and agreement to Paxsoft & Terms of Service listed below.
This Acceptable Use Policy/Terms of Service constitutes an Agreement between PaxHost and it's account holders ("Customers") and System Users. This Agreement applies to all PaxHost Hosting Customers and all users of PaxHost servers & services, including FTP access account holders and all users accessing any World Wide Web server hosted on PaxHost servers and related systems ("System Users"). This Agreement represents the complete agreement and understanding between PaxHost and its Customers and System Users and supersedes any other written or oral agreement.

1. Limitation of Warranty
Paxhost makes no warranties of any kind, whether express or implied, for the
service it is providing. PaxHost
also disclaims any warranty of
merchantability or fitness for a particular purpose. PaxHost
will not be
responsible for damages suffered by any Customer, including, without
limitation, incidental or consequential damages or lost profits. This includes
loss of data resulting from delays, non-deliveries, miss deliveries, system
failures or service interruptions caused by any source whatsoever, including PaxHost's own negligence, subscriber's errors or omissions, or due to the
fault of third parties. Customers understand and agree that PaxHost
undertakes no obligation to maintain, protect or safeguard Customer's data
stored on any PaxHost
equipment or servers and
Customer agrees to accept responsibility for maintaining backup copies of all
such data. Customer agrees to upload and store data to PaxHost
equipment at
Customer's own risk and Customer expressly assumes such risk.
8.2 Billing Pro-Ration Policy – All customers signing up for service prior to the 15th of the month will be billed all applicable setup fees plus a prorated amount due for the remainder of the month. All customers who sign up for service on or after the 15th of the month will be billed all applicable setup fees plus a prorated amount due for the remainder of the month, plus the next month's fees. (Not all accounts subject to this policy.)
8.3 Billing Cycle and Late Fee Policy -- All accounts are billed in advance on the 15th of the month preceding the actual billed month. Customers have up to and including the 15th of the billing month to pay amount due. Payments not received by the 15th day of the month for which service is due, incur a late fee equal to 10% of the amount due or $10, whichever is greater. All accounts not paid by the last business day of the month for which service is due, are subject to suspension. During suspension, sites are not available for FTP or viewing by the public.
Example: A customer would be billed for June service on the 15th of May. The bill would be due by close of business June 15. Payments made after June 15th would incur a late fee. On the last business day in June, in this example, service would be suspended.
8.4 Miscellaneous -- The Customer is responsible for any and all fixed and accumulative charges for this account. In addition to any late fees, past due accounts may be subject to reasonable collection and legal fees as well as interest accrued at 1.5% per month, or the state legal limit, whichever is lower. Returned checks are subject to a charge of $15.00 regardless of amount.
8.5 Plan selection & web space is based on allocated Quota not what is actually in use. For example if your web site plan allows 100MB quota and you only use 23MB you will still have to pay the full 100MB price. All of our plans already have predetermined prices with predetermined space allocated.
8.6 Under no circumstances is Paxhost or it's employees responsible for domain name renewal or expiration of your domain name if your domain name expires with another company or was registered with another company.

Customer Support Options.
Standard Support On all accounts,
– This free support covers issues such as basic setup questions, trouble
reporting, requests to change passwords or user id’s, etc. Standard Support is
not intended to be an educational, site development-Unless you’re a current
subscriber to a specific PaxHost Service such as web site design by
PaxHost, or site error correction service. These latter issues are provided
on a fee basis.
9.1 Customer Support Response. PaxHost makes no guarantee that any support issue or case will be handled within minutes. We handle all support cases on a case by case basis. We make no guarantee to the timely fashion in which we will reply to a support request. As a committed service provider of web hosting and other internet services we will always strive to respond to support requests in as timely fashion as possible.
10. Cancellation of Service – Written
30 Day Notice Required
This agreement is established on a month to month basis. The Customer must
cancel with written 30 day notice sent to the address of PaxHost listed in
this agreement. The Customer agrees that PaxHost has the right to delete all
data, files, or other information that is stored on PaxHost's servers on
behalf of the Customer, if the account is canceled, for any reason, by either
the Customer or provider.
11. Refund ability of Fees
All setup fees (if applicable) and initially billed monthly fees are
refundable uptil 30 days after sign up of a new account.
You as the author of your pages take full responsibility for its contents. As the author you state your page contains nothing illegal, pornographic, nor promotes hate group propaganda. As the author, you also state that nothing on your page is copyrighted material and that any links to other servers have been approved by that organization. You agree that PaxHost has the right (for any reason or no reason) to remove any page. By submitting your pages, you are agreeing to all these conditions.
